Sweet Victory

Because of readers like you, Walmart has announced that Debbie Shank can keep the money from Walmart that she received through her health insurance. Not only that, Walmart isn't just making an exception for her but rather changing their entire policy about issues such as this, allowing for discretion in individual cases.
"Occasionally, others help us step back and look at a situation in a different way. This is one of those times," Wal-Mart Executive Vice President Pat Curran said in a letter. "We have all been moved by Ms. Shank's extraordinary situation." (from CNN.com)

As many of my loyal readers know, my initial reaction to this was I hate Walmart and they ruin Capitalism. Well, after talking it out, I realized they don't ruin capitalism (at least, not as much as I initially thought). Additionally, I also realized that the lawyer representing Debbie Shank did a HORRIBLE job in this case. Legally, Walmart was 100% within their rights to recoup that money. If Mrs. Shank's lawyer didn't realize that suing this trucking company would result in Walmart being able to recover money from them, he didn't do his job. I don't know if he sought to recover lawyer and medical costs in addition to other damages money from the trucking company that the Shank's sued, but if he didn't, again he should be at fault. It could be, however, that he did ask for that in the case but the judge denied it in his/her final ruling.

Anyway, sweet moral victory in this instance. Thanks to readers and fellow bloggers the Shank family can now live a much happier life.
